DMCA Policy

At Witch Finger Pretzels, we respect the intellectual property rights of others and expect our users to do the same. This DMCA Policy outlines our procedures for addressing alleged copyright infringement under the Digital Millennium Copyright Act (DMCA).

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the Witch Finger Pretzels website or services, please notify us by submitting a DMCA Takedown Notice.

Filing a DMCA Takedown Notice

To file a DMCA Takedown Notice with Witch Finger Pretzels, please provide our Designated Copyright Agent with the following information in writing:

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: A description of the material that you claim is infringing and where it is located on our website or services, with sufficient detail to allow us to locate the material (e.g., URL link).
  3. Contact information of the complaining party: Your full name, mailing address, telephone number, and email address.
  4. Good Faith Belief Statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy and Authority Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Physical or Electronic Signature: Your physical or electronic signature (e.g., typing your full name).

Upon receipt of a valid Takedown Notice, Witch Finger Pretzels will take appropriate action, which may include removing or disabling access to the allegedly infringing material.

Filing a Counter-Notification

If you believe that material you posted on the Witch Finger Pretzels website was removed or access to it was disabled by mistake or misidentification, you may file a Counter-Notification with our Designated Copyright Agent. Your Counter-Notification must include the following:

  • Identification of the removed material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled (e.g., URL link).
  • Good Faith Belief Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your Contact Information: Your name, address, and telephone number.
  • Consent to Jurisdiction Statement: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Witch Finger Pretzels may be found, and that you will accept service of process from the person who provided the original DMCA Takedown Notice or an agent of such person.
  • Physical or Electronic Signature: Your physical or electronic signature (e.g., typing your full name).

Upon receipt of a valid Counter-Notification, Witch Finger Pretzels may restore the removed material or cease disabling access to it within 10 to 14 business days, unless the copyright owner files an action seeking a court order to restrain the subscriber from engaging in infringing activity related to the material on our system.
